Car accident claim

With our roads becoming increasingly crowded, it is almost inevitable that you or at least someone you know will be involved in a traffic accident at some point in time. Thankfully today’s cars offer high levels of driver and passenger protection, and most accidents occur at low speeds with only minor injuries being sustained.

The most common form of injury resulting from a car accident is whiplash, which is caused by the head moving forwards in relation to the body, before returning back to position, this violent movement causes damage to the neck muscles and can cause severe pain and reduced mobility of the head. Many people who suffer whiplash in a car accident will claim compensation from the at fault motorist’s insurance company, for both the pain caused and any loss of earnings through not being able to work.

In the UK, it is a legal requirement for all drivers to have at least third party insurance, this covers the driver if they cause harm to another person, to property or to animals. Most insurance companies instruct their customers not to admit or even discuss liability following a crash, advice that you should follow. However, this can present a problem, as if you are involved in an accident that was someone else’s fault, the chances are that they will deny responsibility. If you wish to pursue a compensation claim against them, you will need to be able to prove that they were at fault, this can often be easily proven by the damage on the cars or by witnesses who saw the accident.

In some cases it may be more difficult to prove the fault of the other driver, and their insurance company may refuse to meet a claim against them in the normal manner, in these cases you may need to employ a solicitor to take action on your behalf in order to gain the compensation for the car accident in which you were injured.
